Please read these Terms of Service ("Terms") carefully before using the CachePlex website and service ("Service") operated by CachePlex ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

1. Acceptance of Terms

By creating an account or using CachePlex — whether as a registered user or a guest — you confirm that you are at least 16 years of age and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

CachePlex is an online tool that analyzes publicly accessible websites for on-page search engine optimization (SEO) factors. It provides a scored report listing identified positives, warnings, and issues, and may include an AI-generated executive summary powered by Google Gemini. The Service is provided for informational and educational purposes only.

3. Use of the Service

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. Specifically, you must not:

  • Submit URLs to websites you do not own or have explicit permission to analyze;
  • Use the Service to conduct competitive intelligence in violation of any third party's terms;
  • Attempt to reverse-engineer, scrape, or systematically extract data from the Service;
  • Use automated bots or scripts to submit large volumes of scan requests;
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.

We reserve the right to suspend or terminate access for any user who violates these restrictions.

4. Accounts and Security

When you create an account, you are responsible for maintaining the confidentiality of your credentials. You are solely responsible for all activity that occurs under your account. You agree to notify us immediately if you suspect any unauthorized use of your account. We will not be liable for losses arising from unauthorized use of your credentials.

5. Intellectual Property

The Service, including its design, code, text, graphics, and analysis algorithms, is owned by CachePlex and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without express written permission.

Scan results generated for your URL are yours to use. However, the underlying scoring methodology, rule engine, and AI prompting are proprietary and remain our intellectual property.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that:

  • the Service will be uninterrupted, error-free, or available at all times;
  • analysis results will be accurate, complete, or suitable for any particular purpose;
  • any advice or recommendations provided will result in improved search engine rankings.

SEO is complex and influenced by hundreds of factors outside our control. Scan results are a starting point, not a guarantee of outcome.

7. Limitation of Liability

To the maximum extent permitted by law, CachePlex shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunity — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our aggregate liability for direct damages shall not exceed the amount paid by you for the Service in the twelve months preceding the claim (or $0 if you are a free-tier user).

8. Third-Party Services

The Service may integrate with third-party providers including Google Gemini AI. Your use of those integrations is subject to the respective third-party terms. We are not responsible for the availability, accuracy, or content of third-party services.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.

10. Modifications to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

11. Termination

We may terminate or suspend your access to the Service at our sole discretion, without notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation in the first instance, and thereafter through binding arbitration or the courts of competent jurisdiction.
